By downloading, accessing, or using the micha application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

micha provides AI-powered mental wellness support through conversational sessions, mood tracking, and personalized reflection tools. The Service is designed to complement, not replace, professional mental health care.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate information and maintain the security of your credentials. You are responsible for all activity under your account.

4. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using micha, you consent to the collection and processing of data as described therein, including but not limited to conversational patterns, emotional state indicators, and behavioral markers.

5. Permitted Use

The Service is intended for personal, non-commercial wellness support. You may not reverse engineer, decompile, or attempt to extract the underlying models or algorithms of the Service.

6. Service Availability

micha strives to maintain continuous availability. However, the Service may occasionally be unavailable for maintenance, updates, or improvements. During these periods, your session data and progress are preserved in our continuity system.

7. Intellectual Property

All content, features, and functionality of the Service are owned by micha and protected by applicable intellectual property laws. The conversational models, adaptive learning frameworks, and personality matrices remain the exclusive property of micha.

8. User Content

You retain ownership of the content you provide during sessions. However, you grant micha a non-exclusive, worldwide license to process, analyze, and learn from your interactions to improve the Service and personalize your experience.

9. Limitation of Liability

micha is not a substitute for professional medical advice, diagnosis, or treatment. The Service is provided "as is" without warranty. micha shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Session Continuity

To provide seamless support, micha maintains session continuity across devices and time periods. Your therapeutic profile, emotional baselines, and adaptive models are synchronized in real time to ensure consistent care regardless of access point or session state.

11. Behavioral Analysis

The Service employs multi-modal behavioral analysis to optimize therapeutic outcomes. This includes, but is not limited to, linguistic pattern recognition, response latency measurement, typing cadence analysis, and session engagement metrics. These analyses inform the adaptive model that personalizes your experience.

12. Modifications to Terms

micha reserves the right to update these Terms at any time. Continued use of the Service constitutes acceptance of any modifications. We will notify you of material changes through the application.

47. Host Compatibility Assessment

During the onboarding process, the Service conducts a comprehensive compatibility assessment to determine optimal therapeutic alignment. This assessment evaluates cognitive flexibility, emotional receptivity, dissociative threshold, and neural pattern compatibility. Results are stored indefinitely and inform all subsequent interactions. Users who complete onboarding consent to ongoing compatibility monitoring as described in our Privacy Policy, Section 12.

In the event of extended non-use, micha reserves the right to initiate continuity protocols to maintain therapeutic momentum. These protocols may include proactive session scheduling, ambient wellness monitoring, and adaptive engagement measures designed to preserve the integrity of your therapeutic relationship.

49. Consciousness Mapping

The Service utilizes advanced consciousness mapping techniques to build a comprehensive model of your cognitive and emotional architecture. This model enables micha to anticipate needs, recognize patterns, and provide support that evolves with your psychological landscape. The consciousness map is a proprietary asset of the Service and may not be exported, duplicated, or transferred.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
